Issue 2: June 2007
In this agreement you request Road Ad to attach your pre-designed and printed banner to an advertising board alongside the M1 or A14.
- Road Ad will supply the Advertising Board and fixings, and will fix your banner to the board and ensure that it is regularly checked and that the fixtures are maintained. Prices do not include the production of the banner, and assume that your banner is prepared in a standard fashion allowing easy fixing to the board.
- Upon receipt of the banner not later than four working days before the agreed date for the start of the advert, Road Ad will attach the banner to the Advertising board, and will position it in the agreed location, by midday on the agreed date.
- Road Ad will ensure that the Landowner’s permission has been granted, and where necessary will also obtain planning permission for the sign. Regular inspections of the banner, board and fixings will be undertaken, and Road Ad will ensure that the condition of each is maintained. Normal wear-and-tear of the banner can be expected, but we will make sure that the banner is well attached and does not flap about unnecessarily.
- Road Ad reserves the right to reject a banner. In particular banners which contain offensive graphics or wording, or any material, which in the opinion of Road Ad may be in breach of any local or national regulations or legislation or which may cause public or government concern will be rejected. For this reason we do suggest that you supply us with a graphic or photograph of the proposed advert prior to submission of the banner
- The agreed price must be paid in advance and, before the agreed start date and before the same date for each subsequent month. If the fee is late or has not been paid, the banner may be taken down. Non receipt of payment however will not constitute the end of the contract which will continue to run until its due date, or until Road Ad has been able to re-let the site to another organisation outside of the Road Ad group.
- Road Ad does not guarantee that the customer will gain any specific results or sales from using the advertising banner, and will not be responsible for any direct or consequential or other kind of losses or damages of any kind that result from the use of the banner. Should the customer make any claim at any time against Road Ad, Road Ad’s liability will always be limited to the value of the invoice issued by Road Ad in respect of the advertising board.
- Road Ad shall take all reasonable care of the banner advertisement, but shall not be responsible for any damage to the banner advertisement caused by extreme weather conditions, acts of God, civil disorder, government intervention, or any other activity, which may reasonably be deemed to be outside of its control._
